Electric Boudoir Photography Terms & Conditions

My priority is creating a safe, empowering, and professional experience for every client. These Terms and Conditions outline how we work together, protect both client and studio, and ensure our time together remains clear, positive, and respectful.

Acknowledgement & Consent

By booking a session with Electric Boudoir Photography, the client acknowledges that boudoir and fine art nude photography may include artistic or sensual posing, implied nudity, or full nudity. Clients agree to communicate any posing or levels of nudity they do not wish to do, and all boundaries will be respected. It is the client’s express desire to participate in this session. Because the Studio cannot control how images may later be shared by the client, the client agrees to hold the Studio harmless from any claims or damages related to the content or distribution of images. Sessions are conducted on a closed set. A Studio representative may be present, and clients may bring one approved guest with prior permission.

Privacy & Confidentiality

Client comfort and privacy are paramount. The Photographer may use select images for portfolio, website, awards, or marketing unless the client requests confidentiality in writing. Confidential sessions will include a separate privacy addendum.

Licensing of Images

Clients are granted a non-exclusive license for personal use of purchased, retouched images. This includes personal printing, albums, wall art, private sharing with partners, and social posting of final images. Proofs, raw files, and unedited images are not for sale or distribution and may not be shared online. The Photographer retains copyright to all images.

Copyright & Fine Art Use

The Photographer retains all intellectual property rights. While clients may not license or sell their images, the Studio reserves the right to license or exhibit images for fine art purposes where subjects are unrecognizable (e.g., abstract, silhouetted, or detail crops). This clause protects the integrity of fine art work while respecting client identity.

Social Media Use

Clients may share only final, retouched images. Proofs, screenshots, and unedited images may not be posted or altered. AI edits, overlays, or filters are prohibited. Tagging @electricboudoir is encouraged.

Compensation & Payment

Booking/sitting fee secures the session and is due at the time of booking. This fee includes hair and makeup for up to two people. For products and prints, balances must be paid in full before delivery of final products and prints. Add-ons, albums, or folio boxes are fulfilled only after full payment. Payment plans are available via Afterpay, Klarna, or special arrangement.

Cancellation & Rescheduling

The booking fee is non-refundable. Clients may reschedule once without penalty if reschedule is made two weeks prior to the original booking date; additional reschedules require a new booking fee. The is due in respect to booking hair and makeup artists and/or location rental. If the client fails to perform under this agreement, the full balance becomes immediately due as liquidated damages, since the actual loss is difficult to measure.

Proofs & Final Images

Proof galleries are delivered within 30 days. Clients must select final images within 20 days of proof delivery. Only purchased, retouched images are licensed for use.

Print Orders & Delivery

Prints, albums, and products must be ordered within 30 days of receiving proofs. Orders delayed beyond 60 days are subject to updated pricing. The Studio aims to fulfill orders within 8 weeks, though supplier delays may extend this timeframe. Finished orders must be collected within 21 days of notification.

Liability & Storage

The Studio exercises reasonable care with image capture, processing, and delivery. In the unlikely event of equipment failure, unforeseen events, or negligence, liability is limited to a refund of payments made. The Studio guarantees image storage for six (6) months following the session; after this period, files may be purged. The Photographer is not liable for third-party misuse of images once published.

Force Majeure

Neither the Client nor the Studio will be held liable for delays or non-performance due to events beyond reasonable control, including natural disasters, pandemics, illness, strikes, government restrictions, civil unrest, energy outages, or internet/communications failures. Force Majeure does not include financial distress or market changes. Session fees remain non-refundable but may be applied to a rescheduled date at the Studio’s discretion.
